1       This policy

1.1        This refund and cancellation policy (Policy) applies to events (Events) which you can register to attend via the website (Site) operated by Grokkist Limited (NZCN: 8346829) trading as Grokkist (we, our or us) at: https://grokk.ist.

1.2        If you register for an Event you are taken to have agreed to this Policy. Please read this Policy carefully.  We may, at any time and at our discretion, vary this Policy by publishing the varied policy on our Site. We recommend you check our Site regularly to ensure you are aware of our current Policy.

2       Refunds and Cancellations

2.1        If you have registered for an Event and you wish to cancel your attendance, you must give us at least 24 hours’ notice prior to the scheduled time of the Event of your intention to cancel. If we receive a cancellation notice from you within this timeframe, we will refund you the price you have paid via the Site (Price) to attend the Event in full.  If you give us notice of your intention to cancel your attendance at an Event less than 24 hours prior to the scheduled time of the Event, any refund (or part refund) of the Price will be at our discretion.

2.2        If we cancel an Event for any reason, we will use reasonable endeavours to give you as much notice of the cancellation as possible and will refund you the Price in full.

2.3        If an Event is rescheduled, we will use reasonable endeavours to give you as much notice of the updated date and time of the Event as possible. If you are unable to, or no longer want to, attend the Event at the rescheduled time, we will refund you the Price in full.

3       Liability

3.1        Despite anything to the contrary, to the maximum extent permitted by law:

(a)          our maximum aggregate liability arising from or in connection with an Event will be limited to, and must not exceed, the Price; and

(b)         we will not be liable to you for any loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

3.2        Despite anything to the contrary, to the maximum extent permitted by law, we will have no liability, and you release and discharge us from all liability, arising from or in connection with any:

(a)          failure or delay in providing the Event; or

(b)         breach of the Terms or any law,

where caused or contributed to by any:

(c)          event or circumstance beyond our reasonable control; or

(d)         act or omission of you or your related parties,

and, in any event, any error, omission or lack of suitability (or the absence of, or reduction in, any anticipated result, outcome or benefit) with respect to an Event.
